IN THE HIGH COURT OF PUNJAB AND HARYANA AT

CHANDIGARH CWP No.19651 of 2017 Date of decision:05.09.2017 Iqbal Singh

Versus

The State of Punjab and others

...Respondents

Coram:

Hon'ble Mr. Justice Rakesh Kumar Jain

Present:

Mr. D.V.Sharma, Senior Advocate, with Ms. Shivani Sharma, Advocate, for the petitioner. **** Rakesh Kumar Jain, J.

The petitioner is aggrieved against the order dated 17.08.2017 passed by the Joint Registrar, Cooperative Societies, Patiala Division, Patiala, as per which he ceases to be the Director of the Ludhiana District Cooperative Milk Producers Union Limited, Ludhiana under Rule 25(h) of the Punjab Cooperative Societies Rules, 1963.

Although learned counsel for the petitioner has made submissions on merit but he has candidly admitted and also pleaded in para no.23 of the writ petition that the petitioner has the remedy of revision in terms of Section 69 of the Punjab Cooperative Societies Act, 1961 (hereinafter referred to as the "Act").

After hearing learned counsel for the petitioner and examining the available record, I am of the considered opinion that since there is a remedy under the statute for redressal of grievance of the petitioner, therefore, he should avail that remedy at the first instance instead of invoking extraordinary writ jurisdiction of this Court.

In view of the above, the present writ petition is hereby dismissed on the ground of availability of statutory remedy of revision to the petitioner. September 05, 2017 (Rakesh Kumar Jain) vinod* Judge Whether speaking / reasoned:
