HARINDER SINGH SIDHU, J Petitioners have filed this petition under Section 482 Cr.P.C. for quashing of cross case bearing G.D.No.35 in FIR No.0319 dated 24.09.2020 under Sections 323,452,454,380,427,506,148,149 IPC registered at P.S Sultanpur Lodhi, District Kapurthala and all other consequential proceedings arising out of the said FIR, as the matter stands amicably settled in terms of compromise deed dated 12.07.2021. Vide order dated 23.11.2021, the parties were directed to appear before the trial Court/Illaqa Magistrate on 03.12.2021 for getting their statements recorded with regard to the compromise and the learned Magistrate was directed to send a report about the genuineness and veracity of the compromise.
A report dated 16.12.2021 of learned SDJM, Sultanpur Lodhi has been received. As per the report, the parties had appeared before learned Magistrate and got recorded their statements regarding compromise. MANOJ KUMAR 2022.02.11 10:20 I attest to the accuracy and integrity of this document
CRM-M-39979 of 2021 (O&M) #2# Learned Magistrate has stated that he is of the considered view that the compromise between the parties is valid, genuine, voluntary and without any coercion or undue influence.
Accordingly, the present petition is allowed. Cross case bearing G.D.No.35 in FIR No.0319 dated 24.09.2020 under Sections 323,452,454,380,427,506,148,149 IPC registered at P.S Sultanpur Lodhi, District Kapurthala along with all subsequent proceedings arising therefrom, are hereby quashed qua the petitioners.
