G.S.Sandhawalia, J.(Oral) The challenge is to the letter dated 17.6.2015 (Annexure P6) whereby the NCTE-respondent No.1 has returned the application of the institute for B.Ed. Course on account of the negative recommendation of the State Government.

Admittedly, under the National Council for Teacher Education Act, 1993 (hereinafter referred to as "the Act"), an appeal is provided under Section 18 of the Act against the order under Sections 14, 15 & 17 to the Council. The order, thus, refusing to grant recommendation being appealable, the petitioner has an alternative efficacious remedy available to it and, therefore, the present petition is not maintainable at the first instance before this Court.
