Present revision petition has been filed challenging the order dated 16.05.2024 (Annexure P-6) whereby the evidence of the petitioner has been closed by order.

Learned counsel for the petitioner would contend that only two witnesses are to be examined and given two effective opportunities the petitioner would conclude his evidence.

Mr. Nimanyu Gautam, Advocate has put in appearance on behalf of respondent Nos.1(i) and 1(ii) and has pointed out to the impugned order dated 16.05.2024 to contend that the petitioner had availed 20 effective opportunities to conclude his evidence and that he is trying to delay the matter on one pretext or the other.

In the present case, no doubt the petitioner had already availed 20 opportunities as noticed in the order dated 16.05.2024, however, in order to do complete justice between the parties, two effective opportunities are given to the petitioner to lead his entire evidence at his own risk and responsibility. The said two effective opportunities are given subject to payment of Rs.30,000/- as costs to be paid to respondent Nos.1(i) and 1(ii), which shall be a condition precedent.

Disposed off in the above terms. Pending applications, if any, also stand disposed off.
