JASGURPREET SINGH PURI , J. (ORAL ) The present petition has been filed under Article 226 of the Constitution of India for issuance of a direction, order or appropriate writ to the respondents for the grant of parole to the petitioner for three months for continuing medical treatment of heart. Learned counsel for the petitioner has submitted that vide Annexure P-6, an application was filed with the police authorities on 20.9.2021 but the same has not been considered and decided by the concerned authorities.
This Court vide order dated 14.10.2021, had directed the jail authorities to take the petitioner for follow up to the Fortis Hospital, Mohali, and thereafter, to file a fresh status report on the basis of follow up report.
The State has filed affidavit which is taken on record. As per the affidavit, a report was submitted by the Sr. Medical Officer, Central Jail, Amritsar in which it is stated that the petitioner has a history of coronary artery disease and his angioplasty was done on 6.8.2021 from Fortis Hospital, Mohali. The patient was referred to Guru Nanak Dev Hospital, Amritsar on 15.10.2021 with complaint of chest pain where he got admitted on same date and in view of the orders passed by this Court, the petitioner was again referred to Fortis Hospital, Mohali for follow up on 23.10.2021 and the doctor examined the patient and advised oral medications along with blood investigations and patient was again referred to the Government Hospital for further management and treatment and accordingly, the petitioner is under treatment at Guru Nanak Dev Hospital, Amritsar. Report of Fortis Hospital, has also been attached which shows that follow up was again done.
Mr.Randhir Singh Thind, learned DAG, Punjab has stated that the petitioner is already under treatment in a Government Hospital and follow up has already been taken from the Fortis Hospital, Mohali and the application which he has given vide Annexure P-6 dated 20.9.2021, will be considered in accordance with law and appropriate orders will be passed.
In view of aforesaid position, the present petition is disposed of with a direction to respondent No.3 to consider the representation (Annexure P-6) dated 20.9.2021 filed by the petitioner and decide the same in accordance with law within a period of two weeks from the date of receipt of copy of this order.
