G.S.SANDHAWALIA, J. (Oral) C.M. No. 4144 of 2016 Application for placing on record the third inquiry report sent vide letter dated 25.03.2015 is allowed as Annexure P-9. The same is taken on record.
CWP No. 25008 of 2013 The grouse of the petitioner was that two inquries had already been held against him and he had been exonerated but third inquiry had been started de novo. He had thus sought the quashing of order dated 22.09.2014 (Annexure P-8) whereby, the third inquiry had been initiated. During the pendency of the writ petition, the third inquiry has also ended in his favour, which has now been placed on record as Annexure P-9.
Resultantly, the present writ petition has been rendered infructuous and the same is disposed of accordingly. However, counsel for the petitioner submits that on account of SHIVANI GUPTA 2016.04.07 15:08 I attest to the accuracy and integrity of this document Chandigarh
CWP No. 25008 of 2014 -2the pendency of the inquiry proceedings, his retiral dues have been withheld though he had superannuated on 31.03.2014.
In such circumstances, the competent authority shall ensure that the retiral benefits will be paid to the petitioner within a period of two months from the date of certified copy of the order, in case there is no legal impediment.
