JASWANT SINGH, J (ORAL) The petitioners, eight in number, who belong to the Classical and Vernacular Cadre working with the Education Department (Secondary Education), Punjab, have laid challenge to the impugned order dated 17.2.2012 (P.3) and 07.3.2012 (P.4) whereby the benefit of the pay scales granted to them equivalent to that of teachers such as Hindi/Punjabi/Sanskrit/Urdu has been withdrawn vide order dated 12.5.2011 (P.2); with further writ of Mandamus for granting them the same pay scales as granted to the teachers of Hindi/Punjabi/Sanskrit/Urdu.
The main grouse for claiming the relief is the reliance on judgment dated 07.5.2009 passed by the learned Single Judge of this Court in CWP No.16380 of 1989 (P.1).
It is not in dispute that the judgment dated 07.5.2009 (P.1) was set aside vide judgment dated 11.5.2012 passed in LPA
CWP No.7071 of 2012 #2# No.270 of 2012, which has since been upheld by Hon'ble Supreme Court vide order dated 13.1.2015 passed in SLP © No.422 of 2013. In view of the aforesaid, the matter being fully covered by the aforesaid judgments passed by the LPA Bench and upheld by Hon'ble Supreme Court, no further adjudication is required. Dismissed.
