The petitioner has approached this Court under Articles 226/227 of the Constitution of India inter alia seeking quashing of the letter dated 24.12.2015 (Annexure P-35) issued by respondent No. 3 and order dated 11.04.2016 (Annexure P-37) passed by respondent No. 2. 2.

It was not disputed that certain questions of fact are involved in this case which are required to be established by leading cogent and convincing evidence. Accordingly, learned counsel for the petitioner submitted that the instant petition may be disposed of by relegating the petitioner to the alternative remedy of civil suit. After hearing learned counsel for the petitioner, perusing the averments made in the present petition and without expressing any opinion on the merits of the controversy, we dispose of this petition by relegating the petitioner to avail the alternative remedy as may be available to it, in accordance with law.
