The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking setting aside of order dated 22.09.2020 (Annexure P-5) whereby his candidature was rejected in Group-1 and he was shifted to Group-3.

Counsel for the respondent, at the outset, submits that another candidate has already been selected and claim of the petitioner was rejected because he offered unregistered lease deed. In the brochure, it is specifically mentioned that lease deed should be registered, thus, he was shifted to Group-3. Another candidate in Group-1 was available, thus he came to be selected. Faced with this, counsel for the petitioner does not press the present petition and seeks permission to avail remedies as permissible by law. 4.
