In the present writ petition, the petitioner is challenging the impugned public notice dated 09.04.2025 (Annexure P-7) qua the vacancy of a new fair price shop for village Harhar Kalan, Tehsil Ajnala, shown at serial No.132 issued by respondent No.4.

Learned counsel appearing on behalf of the petitioner submits that in light of the Policy dated 07.12.2020 (Annexure P-5), in respect of number of vacant vacancies in urban and rural areas at the ward/village level is concerned, there should be one fair price shop where upto 200 ration cards holder are attached to the shop and where there are more than 200 ration cards holder attached to the shop, a second vacancy be counted.

Learned counsel for the petitioner further submits that the ration cards holder attached to the fair price shop run by the petitioner in village Harhar Kalan, Tehsil Ajnala, are only 194 as such, another vacancy could not have been advertised in pursuance to the public notice dated 09.04.2025 (Annexure P7) pertaining to village Harhar Kalan, Tehsil Ajnala. 3.

Mr. Rohit Ahuja, DAG, Punjab, accepts notice on behalf of respondents and on instructions from Mr. Mahinder Pal, District Food Supply Officer o/o District Controller, District Amritsar submits that at the time of issuance of the public notice dated 09.04.2025 (Annexure P-7), the ration card attached to the fair price shop being run by the petitioner was more than 200 in number. However, after issuance of the above said public notice and upon completion of the e-KYC process, the number of ration cards holder attached to the fair price shop being run by the petitioner were less than 200 i.e. 194 card holders.

Taking into consideration the above said facts, learned State counsel submits that the vacancy which is advertised at serial No.132 pertaining to village Harhar Kalan, Tehsil Ajnala, in pursuance to the public notice dated 09.04.2025 (Annexure P-7) will not be filled in light of the policy dated 07.12.2020 (Annexure P-5). However, learned counsel further submits that in case, the number of ration cards holder attached to the fair price shop being run by the petitioner in village Harhar Kalan, Tehsil Ajnala exceeds beyond 200, in that case, the department will issue a fresh notice, if so desire, for filling up of the second vacancy.

In light of the statement given by learned counsel appearing on behalf of respondents, learned counsel appearing on behalf of petitioner submits that the present writ petition may be disposed of as rendered infructuous.

In view of the above said submission, the present writ petition is disposed of as having been rendered infructuous. 8.
