The challenge in this petition filed under Articles 226/227 of the Constitution of India is to Memo No.LC-3027/PA(B)-2013/139 dated 01.01.2014 (Annexure P-10) vide which the license Application dated 19/20.08.2013 (Annexure P-3) submitted by the petitioners, was not considered and returned by respondent No.2 under Rule 7 of the Haryana Development and Regulation of Urban Areas Rule 1976 and the order dated 26.09.2016 (Annexure P-14) passed vide Memo No.LC-3027-JE(S)/20206 vide which the review application dated 05.06.2014 (Annexure P-11), was dismissed by respondent No.2 inspite of the fact that the petitioners fulfilled all the requisite parameters for the grant of license, for setting up an Affordable Housing Colony in Sector 86, Faridabad. Further prayer has also been made to restrict the respondents to grant the Letter of Intent (LOI) to the private respondents, till the decision of the appeal bearing No.34/2016 dated 29.09.2016 filed by the petitioners before respondent No.1.

After arguing for sometime, learned counsel for the petitioners states that he may be allowed to withdraw the present writ petition at this stage. However, a prayer was made that liberty be granted to the petitioners to raise all the pleas before the Appellate Authority.

Dismissed as withdrawn. It shall, however, be open to the petitioners to take recourse to the remedies as may be available to it, in accordance with law.
