Evidently, the order of punishment was passed on 11.03.2003 by the Superintendent of Police, Yamuna Nagar, thereby stopping four annual increments with permanent effect. In the appeal preferred against the aforesaid order, the Appellate Authority/Inspector General of Police, Ambala Range, Ambala, reduced the punishment and ordered stoppage of one increment with permanent effect vide order dated 24.05.2006. [2].

Perusal of the record would indicate that in the year 2016, the petitioner had also filed CWP No.12178 of 2016, PRINCE SAINI 2023.02.13 15:23 I attest to the accuracy and authenticity of this order/judgment

CWP No.18145 of 2018(O&M) assailing some different charge-sheet and order of punishment of stoppage of three annual increments with cumulate effect and the said writ petition was disposed of by this Court vide order dated 20.04.2022. The present cause of action was very much available at that time when the aforesaid writ petition was filed, but the petitioner did not assail the aforesaid appellate order in the said writ petition and by now, the cause of action is ex facie time barred in respect of cause of action, which accrued to the petitioner in the year 2008. The petitioner stands retired even prior to the filing of the present writ petition. [3].

In view of facts and circumstances of the case, I do not find any ground to interfere in this writ petition and the same is accordingly dismissed.
