The petitioner through instant petition under Articles 226/227 of Constitution of India is seeking direction to respondents to renew his passport.

Learned counsel for the petitioner inter alia contends that petitioner was implicated in FIR No. 60 dated 30.05.2010, under Sections 379/506 of IPC, registered at Police Station, Raja Sansi, District Amritsar. The police after completing investigation has filed cancellation report. The cancellation report was filed in 2010, however, petitioner is not aware of present status. There is no other criminal case pending against the petitioner. 3.

CWP No, 15358 of 2023 -12023:PHHC:097146 submits that petitioner has not submitted documents relating to aforestated FIR, thus, application of the petitioner could not be processed. The petitioner may be directed to come present in the office of respondent No. 3 alongwith present status of the FIR and thereafter passport authority would pass an appropriate order 4.

This Court vide judgment dated 14.07.2023 passed in CWP No. 27167 of 2018 has disposed of identical issue. 5.

On being confronted with the aforesaid fact, Ms. Monica Chawla, Advocate for Union of India concedes that facts of the present case are identical to case of Mohan Lal @ Mohna vs. Union of India and others, CWP No. 27167 of 2018.

The issue involved in the present case is squarely covered by judgment dated 14.07.2023 of this Court passed in CWP No. 27167 of 2018.

The respondent No. 3 shall communicate the date of appearance to the petitioner within two weeks from today and on the date fixed, the petitioner shall remain present. 6.

The instant petition stands disposed of in view of aforesaid judgment and passport authorities are directed to pass order in the same terms.
