The petitioner, who is serving the Haryana Police as a Head Constable, has been issued a notice to show cause as to why he may not be compulsorily retired under Rule 9.18 (2) of the Punjab Police Rules, 1934 (as applicable to the State of Haryana). The petitioner has submitted a reply to the Show Cause Notice, but no final decision thereupon has been conveyed. The petition thus is clearly premature. In view of the aforesaid position, learned counsel for the petitioner seeks withdrawal of the writ petition. C. W. P. No. 2348 of 2016 seeks liberty to file a supplementary reply to the Show Cause Notice giving therein additional and factual grounds.

Dismissed as withdrawn, with liberty as prayed for. The grounds, to be submitted by the petitioner, be filed within ten days from today and on receipt thereof, respondent no.2 is directed to take a final decision thereupon after considering and recording findings of each of the grounds taken by the petitioner, after giving opportunity of hearing to him.
