PARMOD GOYAL, J. (ORAL) The present civil revision petitions have been preferred under Article 227 of Constitution of India by petitioner(s) being aggrieved by order dated 30.04.2026 (Annexure P-8), passed by learned Civil Judge (Junior
-2Division), Karnal whereby their applications under Section 151 of CPC, 1908 for consolidation of three suits bearing Civil Suit No.3750 of 2018, No.944 of 2019 and No.1245 of 2019, were dismissed on the ground that since in all the three suits respective plaintiffs had sought relief on different cause of actions and evidence required to prove the respective cases is also different, therefore, all the three suits cannot be consolidated and tried together. Rather all the three civil suits will be decided by the same Court but separately.

On consideration, I do not find any error in the order passed by learned Court of first instance. Admittedly, in all the three suits different cause of actions have been pleaded. In civil suit No.3750 of 2018 validity of gift deed dated 07.09.2017 is under challenge, whereas in civil suit No.994 of 2018 validity of sale deed dated 29.11.1978 on the ground of misuse of GPA dated 25.11.1982 was challenged and in civil suit No.1245 of 2019 rendition of accounts and recovery of mesne profits has been sought. 3.
It is also admitted that the subject matter of gift deed, sale deed and GPA pertains to different properties, though related to estate of Gopal Singh, through whom parties are litigating in the present case. Since different documents are under challenge, therefore, evidence required in all the three cases need to be different, as in all the three cases different set of witnesses are required to be examined for proving gift deed, sale deed and GPA and different set of witnesses would be required by the other side to disprove the case of petitioner/plaintiff in respective suits. Therefore, as far as consolidation of cases is concerned, learned Court of first instance has rightly held that the suits cannot be consolidated as consolidation would
-3result in more confusion, than trying the suits separately. 4.
However, in view of the facts and circumstances of the present cases, as all the suits pertain to estate of Gopal Singh, it is directed that all the three suits be tried separately by the same Court and learned District Judge shall ensure that all the three cases are marked to the same Court for disposal in accordance with law.

In view of above, all the revision petitions are accordingly disposed of.
