(ORAL) In the present writ petition, the claim has been made by the petitioner that his service, which he rendered on work charge basis, should be taken into consideration while calculating his pensionary benefits. In this petition, he prayed for recalculating his pensionary benefits after adding work charge service as well. Notice of motion was issued.
Counsel for the respondents has placed on record copy an order dated 10.01.2018 by which, claim of the petitioner stands admitted and his pensionary benefits were revised. CWP-23505-2016 (O&M) -2counsel for the respondent states that even the pension of the petitioner has also been revised and arrears of pension has also been released to him.
Learned counsel for the petitioner submits that he is not in a position to rebut the statement made on behalf of the respondents and time be granted to verify the same.
In view of the statement made on behalf of the respondents, the present petition stands disposed of as no further cause of action survives.
In case, the petitioner is left for any other claim, he will be at liberty to file a representation with the respondents for the same within a period of four months from today. Further, if any such representation is filed, then the same shall be decided expeditiously within a period of three months thereafter.
