The petitioner seeks grant of regular bail in respect of a case registered vide FIR No.61, dated 15.4.2019, Police Station City Hoshiarpur, District Hoshiarpur, under Section 379-B IPC. 2.
The FIR was lodged at the instance of Rajni Devi wherein it is alleged that on 15.4.2019 while she was on her way to her parental village, two boys with muffled faces came on Activa scooter and MOHAN SINGH 2021.03.26 19:20 I attest to the accuracy and integrity of this document

Learned counsel for the petitioner has submitted that he is nowhere named in the FIR and has been nominated on the basis of a statement made by co-accused Manoj Kumar who already has been granted bail.

Opposing the petition, learned State counsel has submitted that since the petitioner has been specifically named by his co-accused and also happens to be involved in some other cases, no case for grant of bail is made out. Learned State counsel has not disputed the fact that the petitioner has been behind bars since the last about 8 months and that challan already stands presented.

Having regard to the facts and circumstances of the case and while noticing the custody of the petitioner who has been behind bars since the last about 8 months and challan already stands prsented, further detention of the petitioner will not serve any useful purpose. The petition, as such, is accepted and the petitioner is ordered to be released on bail subject to his furnishing bail bonds to the satisfaction of learned trial Court/Chief Judicial Magistrate/Duty Magistrate concerned.
