       Learned counsel for the petitioners submits that in the instant case the appointed arbitrator has already passed an award on 17.11.2021, against which an application under Section 34 of the Arbitration and Conciliation Act, 1996 has been filed by the petitioner which is pending adjudication before the competent Court of law.

In the circumstances, it is submitted by learned counsel for the petitioners that the present application filed under Section 11 (6) of the Arbitration and Conciliation Act, 1996 has been rendered infructuous. In view of the statement made by learned counsel for the petitioners, the application is dismissed as having rendered infructuous.
