**** HARSIMRAN SINGH SETHI , J. (ORAL) In the present writ petition, petitioner is challenging the order dated 25.03.2019 (Annexure P-14), by which the recovery of `5,45,096/- has been imposed upon him keeping in view the show cause notice issued to him dated 22.01.2018.

Counsel for the petitioner states that after the retirement of the petitioner, no benefit has been extended to him initially due to the pendency of the said show cause notice and thereafter due to imposition of punishment of recovery, though, the amount for which he is entitled for as retiral benefits is more than `5,45,096/-, therefore, the respondents be directed to atleast release the amount of pensionary benefits which is over and above of `5,45,096/-.

CWP-20253-2019 -2Counsel for the petitioner further states that against the order of punishment dated 25.03.2019 (P-14), petitioner has already filed a statutory appeal on 08.05.2019 (Annexure P-15) before the Chairman of the Punjab State Civil Supplies Corporation Limited i.e. the appellate authority and the said appeal though filed on 08.05.2019 has not been decided so far and due to the pendency of the said appeal, petitioner is suffering as his total retiral benefit have been withheld by the respondents.

Counsel for the petitioner states that though the petitioner has made a prayer to challenge the order dated 25.03.2019 (P-14) by which the punishment has been imposed upon him, but at this stage, he will be satisfied in case a time bound direction is issued to the respondents to decide the appeal dated 08.05.2019 (Annexure P-15) by passing an appropriate speaking order.

In view of the request made, without expressing any opinion on the merits of the case or the claim being made by the petitioner, the respondents are directed to decide the appeal dated 08.05.2019 (Annexure P-15) by passing a speaking order within a period of three months from the date of receipt of a certified copy of this order. Present writ petition stands disposed of.
