The challenge in this petition filed under Articles 226/227 of the Constitution of India is to the letter dated 28.10.2014 (Annexure P-4) passed by respondent No.3 vide which Plot No.851, Sector 9, Jhajjar allotted to the petitioner has been cancelled. Further prayer has also been made to direct respondent No.3 to recall the letter/order dated 28.10.2014 (Annexure P-4) in the light of judgement passed in Civil Writ Petition No.16222 of 2014 on 12.08.2015 titled as 'Parminder Singh and another vs. Haryana Urban Development authority and another' (Annexure P-7). 2.

Learned counsel for the petitioner submitted that the petitioner has claimed himself as bonafide purchaser from respondent No.4 and the said fact requires to be proved by leading evidence. In such a situation, learned counsel submitted that he may be allowed to withdraw the present writ petition. However, a prayer was made that liberty be granted to the petitioner to avail the alternate remedy to approach the Civil Court by way of filing the civil suit.
