(Oral) The petitioner is seeking writ in the nature of mandamus for issuance of direction to respondents to step up his pay at par with his juniors i.e direct recruitees in compliance to instructions dated 23.11.2006 and 13.04.2007 (P-7), which has been adopted by the Nigam vide letter dated 05.03.2007 and revise the pension and pensionary benefits.
On notice, a written statement has been filed on behalf of respondent No. 3 stating therein that pay of the petitioner had already been fixed in the pay scale of Rs.5000-7850/- w.e.f 01.01.1996 corresponding to the pay scale of Rs.1400-2600 by granting 1st ACP and GAURAV ARORA 2016.02.16 15:45 I attest to the accuracy and integrity of this document
CWP No. 25237 of 2014 -2entry in this regard has been made in the service book (R-1) and revised PP No. 13290 and 13417 dated 01.09.2015 had been issued. Arrears of pension amounting to Rs.2148 and difference of DCRG amounting to Rs.11,236/- have been paid to the petitioner (R-3/2). As per Annexure R-3/3, the arrear of pension was given to the petitioner w.e.f 01.08.2005 to 28.02.2006 and after 28.02.2006, the pension has been transferred in SBP Jind and revised gratuity. In view of the above, the present petition stands disposed of with a direction to the respondent to send the revised pension of the petitioner after 28.02.2006 to SBP Jind so that the petitioner can get the revised pension from the Bank.
