In this writ petition filed under Articles 226 and 227 of the Constitution of India, the petitioner has prayed for issuance of a writ in the nature of mandamus for directing respondent No.1 to notify the provisional completion which has been duly granted and certified by the independent engineer in terms of the agreement dated 14.12.2012 (Annexure P-1). 2.

At the outset, learned counsel for the petitioner submitted that during the pendency of the present writ petition, the respondents have further sent the recommendation in favour of the petitioner to the higher authorities. It was prayed that in such circumstances, he may be allowed to withdraw the present writ petition with liberty to the petitioner to approach this Court again, in case any adverse order is passed by the authorities.
