The petitioner seeks grant of anticipatory bail in respect of the above mentioned FIR.

The allegations are broadly to the effect that the petitioner had allegedly cheated the complainant of an amount of Rs.40 lakhs. 3.

Vide order dated 9.10.2023, the parties had been referred to Mediation and Conciliation Center of this Court to probe the possibility of compromise. 4.

Learned counsel representing the petitioner submitted that the matter stands amicably resolved and that the entire agreed amount of Rs.40 lakhs stands paid.

Learned counsel representing the complainant/respondent No.2 has endorsed the factum of compromise and has stated that the agreed amount of Rs.40 lakhs has been received by the complainant. It has further been submitted that the complainant does not have any objection for grant of anticipatory bail to the petitioner.

In view of the aforestated position, the instant petition is allowed and it is ordered that the petitioner, in the event of his arrest, be released on bail subject to his furnishing personal bonds and surety bonds to the satisfaction of Arresting/Investigating Officer. However, the petitioner shall join the investigation as and when called upon to do so and cooperate with the Investigating Officer and shall also abide by the conditions as provided under Section 438 (2) Cr.P.C.
