In a suit seeking decree of permanent injunction filed by the plaintiffs (petitioners herein), prayer was also made for interim injunction. Trial Court by way of the impugned order dated 15.05.2025 (Annexure P1) declined the said relief.

Assailing the aforesaid order, learned counsel contends that justifiable reasons are required to be given by the Court to grant or reject the prayer as to stay. To support this contention, learned counsel refers to Birwati Chaudhary and others Vs. State of Haryana and others, (2018) 9 SCC 458. 3.
On query, it is conceded by learned counsel for the petitioners that the petitioners have not assailed the impugned order before the Appellate Court, which remedy is available to them under Order 43 CPC. 4.
