The present application has been filed under Section 482 Cr.P.C for preponement of the main case, which is fixed for 20.09.2023 to some early date.

For the reasons recorded in the application, the same is allowed and the main case is taken on Board today itself. CRM-22050-2023 1.

The present application is for withdrawal of the amount of Rs.30,000/- deposited with the Registrar General of this Court vide receipt No.9601 dated 20.09.2022.

Learned counsel for the petitioner submits that in fact, the main petition under Section 125 Cr.P.C preferred by the respondent has PARUL 2023.05.25 10:31 I attest to the accuracy and authenticity of this document

2023:PHHC:073924 CRR(F)-699-2022 (O&M) been dismissed on 03.04.2023, hence, the present petition has also been rendered infructuous.

In light of the above, Registry is directed to refund the amount of Rs.30,000/- deposited by the petitioner against proper receipt, however, the same shall remain subject to any claim by the respondent, if so agitated. 4.

CRM stands disposed of.

In light of the fact that the main petition under Section 125 Cr.P.C. already stands decided vide order dated 03.04.2023, therefore, nothing survives in the present petition and as such the present petition has been rendered infructuous.
