Jaswant Singh,J(Oral) Petitioner is working as Assistant Engineer (Civil) with Punjab State Power Corporation Limited. He was charge sheeted vide Memo dated 20.12.2010(P-1) and disciplinary proceedings culminated into order imposing major penalty of stoppage of two annual increments with cumulative effect vide order dated 5.4.2013 (P-2). The statutory appeal filed by him under the Employees Punishments and Appeal Regulations,1971 (for short 1971 Regulations) was dismissed vide order dated 15.7.2016 (P-5).
By filing present writ petition the petitioner is seeking quashing of punishment order P-2 and the appellate order P-5 and a mandamus for granting ante dated promotion as Assistant Executive Engineer w.e.f. 20.2.2012 when his Juniors were promoted and his case kept under sealed cover.
At the time of arguments, prayer is restricted only for a direction to the authorities concerned for disposing of the review application (P-6) filed by the petitioner before Board of Directors i.e. the Appellate Authority within a time bound manner. CWP 23613/2016 stated to have been filed by virtue of Regulation 32 of the 1971 Regulations. The restricted prayer is reasonable and hence accepted. Accordingly, present writ petition is disposed of with a direction to the Appellate Authority/Board of Directors of Punjab State Power Corporation Limited to consider and decide the review petition (P-6) filed by the petitioner against aforesaid punishment awarded to him, within a period of four months from the date of receipt of certified copy of this order by passing a speaking and reasoned order. Disposed of accordingly.
