* * * * S.J. VAZIFDAR, A.C.J. (ORAL) The petitioner had approached the Permanent Lok Adalat in respect of his entitlement to be allotted a flat under the Chandigarh Small Flats Scheme, 2006. By an order dated 21.01.2015, the Permanent Lok Adalat ordered the petitioner's name to be included in the seniority list being prepared by the Chandigarh Housing Board.

The petitioner thereafter made an application for the allotment of a flat to the Chandigarh Housing Board. The petitioner has not received any reply to the same. The petitioner alleges orally before us that persons lower in the seniority list have been allotted flats. The details thereof have not been furnished in the writ petition.

The writ petition is, therefore, disposed of by granting the petitioner liberty to make a representation to the respondents furnishing particulars, if any, of flats having been given to persons lower in the seniority list. The representation, if made, shall be decided by the respondents within four weeks of the receipt thereof. If the allotment is not made and if in fact allotments have been made after the date of the order of the Permanent Lok Adalat to persons lower in the seniority list, the respondents shall furnish reasons for having done so. 4.

Needless to add that the petitioner is always at liberty to challenge the refusal to allot, if any.
