This order will dispose of three appeals bearing RFA No.3470 of 2009, 3747 and 3748 of 2014, as common questions of law and facts are involved therein. However, the facts have been extracted from RFA No.3470 of 2009.
The landowner is in appeal seeking enhancement of compensation for the acquired land.
Briefly, the facts are that vide notification dated 20.11.2003, issued under Section 4 of the Land Acquisition Act, 1894 (for short, 'the Act'), Union Territory, Chandigarh sought to acquire land situated within the revenue estate of village Lahora, Union Territory, Chandigarh, for public purpose. The same was followed by notification issued under Section 6 of the Act dated 18.11.2004. The Land Acquisition Collector (for short, "the Collector") vide his award dated 28.2.2005 assessed the market value of the acquired @ ` 15,54,098/- per acre. Dissatisfied with the award of the Collector, the landowner filed objections. On reference, the learned court below, vide award dated 6.3.2009 determined market value of the acquired land @ ` 23,13,139/- per acre. It is this award which is impugned by the landowner before this court. Learned counsel for the landowner(s) submitted that the claim made in the present set of appeals is squarely covered by judgment of this SHARMILA 2015.10.28 14:34 I attest to the accuracy and authenticity of this document.

R. F. A No. 3470 of 2009 (2) Court in RFA No. 2025 of 2009 Sh. Kanwaljit Singh Mujral and another vs Union Territory, Chandigarh, decided on 17.8.2015, whereby compensation for the land acquired vide same notification was enhanced to ` 27,90,000/- per acre.
Accordingly, for the reasons recorded in Sh. Kanwaljit Singh Mujral'
