By virtue of instant petition, preferred under Article 226/227 of the Constitution of India, petitioner has sought issuance of a writ in the nature of Mandamus directing respondent No.3 (RPFC) to release the pension on the basis of last pay drawn issued by endorsement No. Admn-1/A-5-PF-03/821-23 dated 15.01.2010 by HTC and Memo No. HTC-09/Admn-1/A-6/5665-5720 dated 12.06.2009, in terms of judgment passed by Hon'ble Supreme Court in RC Gupta and ors. v. Regional Provident Fund Commissioner, Employees Provident Fund Organisation and ors., 2017 (3) CLR 374. 2.

At the very outset of the arguments, learned counsel for the petitioner submits that though petitioner moved several representations (P-5 colly) to the respondents but till date no conscious decision has been taken. Instant petition is disposed of with a direction to respondents particularly respondent No.3-Regional Provident Fund Commissioner Employee Provident Fund Organization (Pension Revision), Ministry of Labour and Employment, Chandigarh to consider the claim set up by the petitioner in representation(s) (P-5) and take a conscious decision, within a period of three months from the date of receipt of certified copy of this order. 4.

However, if the petitioner still feels aggrieved against any of the order(s) passed by the concerned authority, he shall be at liberty to have recourse to the remedies available under law as well as to approach this Court.
