NIDHI GUPTA, J. (ORAL) Prayer in this 1st petition filed under Section 439 Cr.P.C., is for grant of regular bail to the petitioner in case FIR No. 59 dated 26.06.2023 (Annexure P-1) registered under Sections 307, 323, 324, 325, 354, 452, 212, 148 and 149 IPC at Police Station Hariana, District Hoshiarpur.

Learned counsel for the State has filed custody certificate dated 21.07.2024 which is taken on record, as per which the petitioner has been in custody as an undertrial for a period of 11 months and 23 days.

After arguing for some time, when this Court is not inclined to accord the benefit of regular bail to the petitioner, learned counsel submits that he may be permitted to withdraw the instant petition, at this stage.

Permitted to do so.

Dismissed as withdrawn, at this stage.
