By virtue of instant petition, preferred under Article 226 of the Constitution of India, petitioner has sought issuance of a writ in the nature of Mandamus directing the respondents to re-fix and re-calculate the retiral benefits i.e. commuted pension, leave encashment on the basis of last drawn pay i.e. Rs.28755/- i.e. Basic Pay Rs.10300/-, Grade Pay Rs.3200/-, DA Rs.15255/- by adding dearness allowance component for the basis of calculating average emoluments reckonable for pension along with arrears and interest @18% per annum on delayed payments.

At the very outset of the arguments, learned counsel for the petitioner submits that though petitioner served legal notice dated 26.04.2018 (P-5) upon the respondents but till date no conscious decision has been taken. Instant petition is disposed of with a direction to respondent No.2Director General of Police, Punjab, Sector 9, Chandigarh to consider the claim set up by the petitioner in legal notice (P-5) and take a conscious decision, within a period of three months from the date of receipt of certified copy of this order.

However, if the petitioner still feels aggrieved against any of the order(s) passed by the concerned authority, he shall be at liberty to have recourse to the remedies available under law as well as to approach this Court.
