A direction issued in the Original Application filed by the 2nd respondent Yogesh Kumar Saxena to the competent Authority to conclude the relevant departmental deliberation against the applicant and the consequential action, if any, warranted thereunder, in the light of DOPT OM No. 20011/1/2008-Estt.(D) dated 11.11.2010 on the basis of consensus expressed by both the parties is under challenge in the Writ Petition filed by the Union of India and others. Heard the submissions made by learned counsel appearing for the petitioner.

Firstly, we find that the Original Application filed by the 2nd respondent was disposed of by the learned Central Administrative Tribunal based on the consensus expressed by the parties. Secondly, the order passed by the Tribunal was quite innocuous, inasmuch as, a simple direction was issued to conclude the departmental deliberation pending against the applicant in the light of the memorandum issued by DOPT on 11.11.2010. Thirdly, despite the time bound directions issued to the petitioners, they have chosen to file the present Writ Petition after a lapse of 21⁄2 years which has not been explained by them.
