"( " petition under Article 226 of Constitution of India read with Section 528 of ) *+ ,, -.-/seeking necessary direction to official respondents No. 2 and 3 to take immediate steps to ensure the safety of petitioners who are senior citizens and are not keeping good health from private respondents No.5 to 7 or any other order or direction which the court may deem fit in the given facts and circumstances of the case.

Learned counsel for petitioners pointed out that marriage of their son Mandeep Singh took place with respondent No. 5 Komalpreet Kaur on 29.11.2015. Out of this wedlock, they have a daughter. Both Mandeep Singh and Komalpreet Kaur were doing their respective jobs and they never stayed with them at Bathinda. Mandeep Singh and respondent No. 5 jointly purchased house No.810, HIG, Phase 2, Sector-54, Mohali. At present, they are staying with their son Mandeep Singh whereas respondent No. 5 is also residing there along with her daughter. Both petitioners are having health issues. They are facing
harassment from the hands of respondent No.5 and her family members. Respondent No. 4, SHO, Police Station Women Cell, SAS Nagar, Mohali is hostile towards the petitioners and tried to evict them from the shared residence. A complaint was filed on 05.04.2024 whereas the matter was settled by respondent No.5 that she will shift to the second floor. Later on, she never shifted rather remained on the same floor and kept on harassing the petitioners. Present petitioners filed application to Senior Superintendent of Police and SHO Police Station Phase-1, Mohali dated 29.04.2025 (Annexure P-3) to protect their life and liberty but no action was taken. Ultimately, the present petition was filed. 3.
Learned counsel representing State filed status report through registry and the same is taken on record. It is pointed out that regarding matrimonial dispute of their son Mandeep Singh and respondent No.5, FIR No.10 dated 05.03.2025 has been registered under Section 85 of BNS 2023, which is against Mandeep Singh son of the petitioners and petitioner No.1 at Police Station Women Cell SAS Nagar, Mohali. They have been granted anticipatory bail by the court of learned Additional Sessions Judge, Mohali vide order dated 15.04.2025 (Annexure P-2). Both the parties are residing in the same house and often involved in scuffles with each other. Preventive action has been taken under Section 126,169 of BNSS against Mandeep Singh (son of petitioners) and Komalpreet Kaur (respondent No.5). vide DDR No.30 dated 11.07.2025 and DDR No.31 dated 11.07.
2025 respectively at Police Station Phase-1, SAS Nagar and Kalandra has been presented before learned Sub Divisional Magistrate, Mohali.
- they can immediately inform on the said numbers. The PCR has been instructed to keep patrolling in the said area.

I have considered the aforesaid factual position. It is clear that matrimonial dispute is going on between the son of petitioners and respondent No.5. As referred above, FIR No.10 dated 05.03.2025 has already been registered. Present petitioners are the parents of Mandeep Singh and they are residing in the same flat where respondent No.5 is residing along with her daughter. As per the status report, due to the scuffle between the parties, DDRs No.30 and 31 both dated 11.07.2025 were recorded and Kalandra is already presented before the Sub Divisional Magistrate, Mohali. It is further made clear that both petitioners have been provided phone numbers of MHC and SHO Police Station Phase-1, Mohali and they can call in case there is any threat perception. Merits of the case i.e. FIR and both Kalandra will be decided by the courts concerned on merits. Preventive action is already taken. Therefore, no further action is required and in view of the status report, present petition is accordingly disposed of.
