- ./ 01 Mr. Manuja, has filed an affidavit dated 08.12.2015 in which an assurance has been given that the scrutinization of new draft Rules is under process which is likely to be completed within 15 days and thereafter the draft would be submitted to the Government for following proceedings of accepting in toto of making changes as are deemed fit before the new rules are notified and published in the Gazette. It is professed that this process would take approximately 09 to 12 months and DPC would be convened within one month thereafter once the notification is issued.
On a consideration of the matter, the period of 09 to 12 months is not found realistic or reasonable and in case the request made in para 5 is accepted, it will postpone valuable rights of the parties and therefore, it is directed that either the entire process be VANDANA VERMA 2015.12.15 10:11 I attest to the accuracy and integrity of this document
completed within 06 months or in case all other steps are completed within 06 months and the draft approved for notification, which may be published thereafter, the Government may consider holding DPC in anticipation of the notification and make promotions accordingly which will stand ratified from the date of promotion when the rules are in force. This would balance out the rights between the State and the employees in a just and equitable manner. The affidavit is taken on record. The proceedings are ordered to be closed. The contents of the affidavit are taken as an undertaking to this Court subject to the boundaries placed on it by this order.
The petition stands disposed of.
