(ORAL) In this Petition, the Petitioner who is accused in FIR No.0277 dated 5th December, 2019, registered under Section 302 of the IPC, 1860 and Section 25 of the Arms Act (Section 120-B of the IPC added later on) at Police Station Kharar, District SAS Nagar, has prayed for a direction upon the Respondents to release her Passport which was surrendered by her to Respondent No.4.

As already noted in the earlier order passed by a Co-ordinate Bench on 2nd November, 2020, Regular Bail had been granted to the Petitioner in CRM-M No.13741 of 2020 on 16th June, 2020, and there was no such condition as to withhold the Petitioner's Passport. 3.

The Petitioner happens to be a permanent residence of France, who needs medical treatment in France, and also needs to go there to seek extension of her Permanent Resident Status six months prior to expiry of her DEEPAK KUMAR 2021.01.07 04:41 I attest to the accuracy and integrity of this document

Ld. Counsel for the State has however submitted that the prayer made before this Court actually ought to have been made before the Ld. Trial Court, which has not been done in the present case. 5.

Faced with this Ld. Counsel for the Petitioner seeks permission to withdraw the present Petition with liberty to approach the Ld. Court below for redressal of his grievance.

Ordered accordingly.

It is further directed that if any such application seeking release of the Passport is filed on behalf of the Petitioner, the Ld. Court below shall pass its appropriate order upon the same expeditiously and preferably within a week from the date of the same being filed.
