***** HARSH BUNGER J. (Oral) Present civil revision petition has, inter alia, been filed assailing the judgment dated 23.03.2026 passed by learned Appellate Authority, Panchkula, whereby the judgment dated 07.08.2025 passed by learned Rent Controller, Panchkula, has been affirmed. 2.

On 27.05.2026, following order was passed:- "After arguing for some time when this Court was not agreeing with the arguments of learned counsel for the appellant, learned counsel submits that he may be granted time to vacate the demised premises.

Notice of motion only to the above extent for 02.07.2026. To be shown in the Urgent List."

Mr. A.K. Walia, Advocate appears and files Memorandum of Appearance on behalf of respondents in Court today, which is taken on

CR-4556-2026 (O&M) -2record, subject to all just exceptions. He very fairly submits that the respondents are willing to grant the petitioner a further period of five months from today, to vacate the premises, however subject to the payment of entire arrears of rent, which according to him has not been paid w.e.f. 07.08.2025 onwards and also subject to the petitioner giving an undertaking that the petitioner would continue to pay the rent in advance for subsequent five months from today. The rate of rent is stated to be Rs.3,000/- per month. 4.

Learned counsel for the petitioner has not opposed the aforesaid course being adopted.

Keeping in view the aforesaid broad consensus arrived at between the learned counsel for the parties, the present civil revision petition is dismissed so far as the challenge to the impugned order is concerned, however, the petitioner is granted five months time from today to vacate the premises and handover the vacant peaceful possession to the respondents on 07.12.2026; subject to petitioner submitting an affidavit before the learned Executing Court, Panchkula, undertaking that the petitioner would clear the entire arrears of rent @ Rs.3,000/- per month w.e.f. 07.08.2025 upto date and shall further continue to pay the rent for the next five months in advance. 5.1 Let the aforesaid undertaking be given before the learned Executing Court, Panchkula, within a period of ten days from today.

It is made clear that if the petitioner fails to submit the aforesaid undertaking or defaults in clearing the arrears of rent and/or to make timely payment of rent for the succeeding months, then in that eventuality the instant order shall be of no avail to the petitioner and the petition shall stand dismissed.

CR-4556-2026 (O&M) -36. The present civil revision petition is disposed of in aforestated terms.
