The present petition has been filed under Section 439 Code of Criminal Procedure for grant of regular bail to the petitioner in case FIR No.132 dated 11.6.2022 registered for the offences punishable under Sections 419, 420, 467, 468, 471, 120-B IPC at Police Station Focal Point, Ludhiana.
As per allegations recorded in the FIR, Narinder Singh, Tarsem Singh and Balwinder Singh and wife of Narinder Singh entered into a conspiracy to sell 121⁄2 acres of land owned by the daughter of the complainant and for that purpose, they also got prepared fake Aadhar Card and PAN card of the daughter of the complainant with the help of Sanjeev Kumar @ Sanju.
Counsel for the petitioner submits that the petitioner who is in custody for the last two months and 11 days, was not named in the FIR and that the police has already presented the challan and it will take PARITOSH KUMAR 2022.09.15 13:36 I attest to the accuracy and authenticity of this order/judgment
CRM-M-36789-2022 -2considerable time for the trial to conclude. So, prayer is made for grant of regular bail to the petitioner.
State counsel on instructions from ASI Dalbir has admitted the fact that the petitioner was not named in the FIR and that after completion of investigation, the police has presented the challan. I have considered the submissions made by the counsel for the parties.
All the offences are triable by Judicial Magistrate, 1st Class. Admittedly, the petitioner was not named in the FIR and the police has presented the challan after completion of investigation and presently, the petitioner is lodged in judicial custody and it will take time for the trial to conclude. Thus, no fruitful purpose is going to be served by keeping the petitioner in custody for any further period. In view of the above, without commenting on the merits of the case, the present petition is allowed and the petitioner is ordered to be released on bail subject to his furnishing bail bonds/surety bonds to the satisfaction of the trial Court/Chief Judicial Magistrate/Duty Magistrate concerned.
