**** Rajan Gupta, J. (Oral) Petitioner has posed a challenge to the selection of respondent No.5 as Constable in Punjab Police on the ground that FIR No.13 dated 12.02.2011 under Section 427 IPC has been registered against him at Police Station Kathgarh, District SBS Nagar.

Learned State counsel, at the outset, submits that allegations in the FIR was that certain persons had uprooted trees in the land owned by the petitioner. Name of respondent No.5 figured therein. Detailed investigation was conducted and untraced report was filed before the competent court. In view of the nature of allegations contained in the FIR and untraced report, this court is of the view that no cause of action survives in this petition. Same is hereby dismissed.
