G.S.SANDHAWALIA, J. (Oral) The petitioner seeks the direction that the petitioner be permitted to appear in the two subjects of Charak Samhita and Panchkarma of BAMS 3rd Prof. as a mercy chance.

It is submitted that the examinations are to take place in the last week of December, 2015 and, therefore, the petitioner is entitled for a decision on his representation dated 11.09.2015 (Annexure P-2). It is the case of the petitioner that he was suffering from jaundice and hospitalized, due to which, he was not able to clear his papers. Counsel further submits that he would be satisfied if a time bound direction is issued to the respondents to decide the said representation.

Keeping in view the limited relief sought and without commenting on the merits of the case, this Court does not feel it necessary to call upon the State to file reply.

Accordingly, this writ petition is disposed of with a direction to respondent no. 1 to decide the representation dated 11.09.2015 (Annexure P-2) wherein, the petitioner has sought the mercy chance within a period of two weeks from the date of receipt of certified copy of the order as per the prescribed rules and regulations. Needless to say that if the relief is to be denied, a speaking order be passed.
