Criminal Misc. No. M-31464 of 2019 -2Criminal Misc. No.M-31464 of 2019:

Prayer in the present petition filed under Section 438 of the Code of Criminal Procedure, 1973 is for grant of anticipatory bail to the petitioner in case FIR No.31 dated 19.02.2019 under Sections 323, 341, 354, 325,, 509, 309, 379-B read with Section 34 IPC registered at Police Station Civil Lines, Sirsa.

Learned counsel for the petitioner states that pursuant to order dated 02.09.2019 of this Court, the petitioner has joined investigation. Learned State counsel, on instructions from Insp. Samarjeet, does not dispute the aforesaid fact and submits that the custody of the petitioner is no more required.

However, counsel for the complainant submits that recovery of Rs.14,000/-, an ATM card and some documents are yet to be recovered in the case.

I have heard learned counsel for the parties. Considering the fact that the petitioner has joined investigation and his custody is no more required, the present petition is allowed and the interim order dated 02.09.2019 is made absolute. However, the petitioner shall join the investigation as and when directed by the investigating agency and shall abide by the terms and conditions laid down under Section 438(2) Cr.P.C.
