Through instant petition, preferred under Article 226/227 of the Constitution of India, petitioner has sought issuance of a writ in the nature of mandamus directing the respondents to grant the benefits of ACP on completion of 10 years & 20 years of service under the Assured Career Progression Scheme from the due dates along with all consequential benefits i.e. re-fixation of pension, arrears of pay with 18% interest etc. AND further to release the DCRG of Rs.10,000/- along with interest.

At the very outset of the arguments, learned counsel for the petitioner submits that though petitioner served legal notice dated 21.05.2018 (P-8) upon the respondents but till date no conscious decision has been taken. He further submits that petitioner feels satisfied in case direction is issued to respondent(s) to decide legal notice (P-8), within a stipulated period. Instant petition is disposed of with a direction to respondent(s) to consider the claim of the petitioner and take a final decision on legal notice dated 21.05.2018 (P-8), within a period of three months from the date of receipt of certified copy of this order.

However, if the petitioner still feels aggrieved against any of the order(s) passed by the concerned authority, he shall be at liberty to have recourse to the remedies available under law as well as to approach this Court.
