Prayer in this writ petition filed by the petitioners under Articles 226/227 of the Constitution of India, is for issuance of a writ in the nature of mandamus, directing the respondents to pay the difference of salary w.e.f. 22.03.2010 to 12.10.2012 and pay the salary after giving proficiency step up increments, calculate and give the leave encashment, by calculating the service to be regularized with effect from the date when they were appointed as Conductors and Drivers, by leaving only 18 months probation period, and also to pay the difference of salary by giving the increments and pay scales from the date of initial date of appointment by leaving 18 months probation period. 2.

Learned counsel for the petitioners relies upon the judgment dated 26.02.2024 passed in CWP No.24567 of 2015 and other connected cases and confines his prayer for deciding legal notice dated 10.04.2024 (Annexure P-5). CWP No.16083 of 2024 (O&M) would be satisfied, if the said legal notice is decided by passing a speaking order within a time bound frame.

I have heard learned counsel for the petitioners and have gone through the record of the case.

Keeping in view the limited prayer addressed at the time of arguments, facts and circumstances of the case but without expressing any opinion on the merits of the controversy, this writ petition is disposed of with a direction to respondent No.1 to expeditiously decide legal notice dated 10.04.2024 (Annexure P-5), submitted by the petitioners by passing a speaking order, preferably within a period of 03 months from receipt of certified copy of this order. Benefits, if any, found due to the petitioners shall be released expeditiously preferably within a period of 04 weeks thereafter.
