(Oral) Learned counsel for the petitioner, after arguing for some time, seeks permission to withdraw the present petition. Learned counsel for the petitioner has, however, submitted that the petitioner is suffering from a severe eye disease namely Retinitis Pegimentis & it is very difficult for the petitioner to travel from Zirakpur (which is his regular place of abode) to Fatehabad for facing trial. Keeping in view the entirety of facts and circumstances of the case, personal appearance of the petitioner before the trial Court is exempted subject to the following conditions :- (i) He will be represented by a counsel;

(ii) He will not delay/stall the proceedings of the trial Court; (iii) He will not dispute his identity as accused; (iv) He will have no objection if the prosecution evidence is recorded in his absence but in presence of his counsel; PARVINDER SINGH 2024.05.08 16:56 I attest to the accuracy and integrity of this document chandigarh
