Learned counsel for the parties have contended that the parties have since entered into an compromise and respondent No.2 - Insurance Company has agreed to settle the matter and pay an enhanced amount of compensation to the tune of Rs.7 lakhs over and above the amount awarded by the Tribunal.

The learned counsel for the appellants states that the appellants are satisfied with the amount and hence do not wish to pursue the present appeal. Learned counsel for the appellants has further contended that the amount of Rs.7 lakhs, which would be received over and above the amount awarded by the Tribunal, would be apportioned in the same manner as was done before the Tribunal. FAO No.4873-2010 (O&M) -2Mr. Paras Money Goyal appearing on behalf of respondent No.2 - Insurance Company has stated that the amount of Rs.7 lakhs would be paid to the appellants within a period of 45 days from the date of receipt of certified copy of this order.

In view of the above and in view of the compromise entered into between the parties, the present appeal is disposed of as having been rendered infructuous.
