By virtue of instant petition preferred under Article 226/227 of the Constitution of India, petitioners have sought issuance of a writ in the nature of mandamus directing the respondents to grant selection grade of Rs.7500-12000 w.e.f. 01.01.1996 instead of 01.08.2000 on the post of lecturers as per Govt. of Haryana letter dated 12.12.2000 (P-1), vide which, Head Masters of Government High School and 20% cadre posts of lecturers of Government High School and 20% cadre posts of lecturers of Government Senior Secondary Schools were granted by the respondents and qua the Head Masters, order issued on 03.02.2015 (P-4) and they were granted w.e.f. 01.01.1996 instead of 01.08.2000 after CWP No.8082 of 2001 was allowed on 01.12.2010 and LPA No.951 of 2011 was dismissed on 31.10.2012 and SLP of State was dismissed on 01.11.2013 and review petition was also dismissed on 02.12.2014. At the very outset of the arguments, learned counsel for the petitioners submits that though legal notice dated 29.06.2018 (P-7) was duly served upon the respondents but till date neither any response has been received nor any decision has been taken thereon. He further submits that petitioners feel satisfied in case direction is issued to respondent No.2 to decide the afore-said legal notice in a time bound manner. 3.
Accordingly, instant petition is disposed of with a direction to respondent No.2-Director of Secondary Education Haryana, Panchkula to consider the case unfolded by the petitioners in legal notice (P-7) and to decide the same in the light of letter dated 12.12.2000 (P-1) as well as judgment passed by this Court in CWP No.8082 of 2001, titled as "R.K. Verma and ors. v. State of Haryana and anr.", decided on 01.12.2010 (P-2), which has attained finality by way of dismissal of LPA, SLP as well as review petition, within a period of three months from the date of receipt of certified copy of this order. 4.
However, if petitioners still feel aggrieved against any order passed by the aforesaid authority, they shall be at liberty to have recourse to the other remedies available under law as well as to approach this Court.
