NIDHI GUPTA, J. (ORAL) Prayer in this 2nd petition filed under Section 438 Cr.P.C. is for grant of anticipatory bail to the petitioner in case FIR No. 37 dated 23.06.2023 registered under Sections 376(2)(n), 377, 354-A, 506, 328 and 384 IPC at Police Station Women, District Fatehabad. Learned counsel for the State refers to para No. 2 of the status report dated 18.09.2023, filed by way of affidavit of Sh. Shukarpal Siraswal, HPS Deputy Superintendent of Police, Traffic, Fatehabad, District Fatehabad (Haryana), to submit that the present petition has been rendered infructuous as the petitioner has already been arrested by the police on 03.08.2023.

There is no representation on behalf of the petitioner and even there was no reason to doubt the aforesaid averment made in the status report.

In view of the above, the instant petition is disposed of as having been rendered infructuous.

However, it is made clear that in case anything survives, it is open for the petitioner to move appropriate application, in accordance with law.
