Prayer in this writ petition is for setting aside notice dated 08.08.2022 issued by respondent No.2 pursuant to order dated 04.05.2022 passed by District Magistrate, Tarn Taran under Section 14 of Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002 (for short, 'SARFAESI Act') on the ground that no notice under Sections 13(2) and 13(4) of the SARFAESI Act was issued to the petitioner. Learned counsel appearing for respondent-Bank submits that this writ petition is rendered infructuous as loan account of petitioner has been settled and closed.

Be that as it may, in view of categoric statement of learned counsel for respondent-Bank, we do not find any justification in continuing present proceedings.

Accordingly, writ petition is disposed of as infructuous. However, liberty is afforded to petitioner to file appropriate application within four weeks in case any incorrect fact has been placed before us. 6.
