**** ANUPINDER SINGH GREWAL, J. (ORAL) The petitioner is seeking regular bail in FIR No.176 dated 23.05.2020, under Sections 346 IPC, registered at Police Station Chandhut, District Palwal.
Learned counsel for the petitioner contends that the allegations in the FIR are that the father of the complainant had been abducted by the accused who had also tried to blackmail him. He further contends that father of the complainant is alleged to have been released unharmed after two days. He also contends that the victim, in his statement to the police, did not name the petitioner. The petitioner was arraigned as an accused on the supplementary statement of the victim. The petitioner is in custody for over 6 months. He also contends that the co-accused Khatija @ Khutto @ Satija and Sapat have been granted concession of regular bail by this Court in CRM-M29407-2020 on 29.09.2020 and CRM-M-32815-2020 on 27.10.2020 respectively.
CRM-M-35969-2020 Learned State counsel, upon instructions from ASI Munim Singh, contends that although challan has been filed but no prosecution witness has been examined. She further contends that the petitioner was arraigned as an accused on the supplementary statement of the victim. Heard through video conferencing.
In view of the submissions of learned counsel for the petitioner, especially when the petitioner is in custody for over 6 months, the co-accused have been granted bail, COVID-19 pandemic and the conclusion of the trial is likely to take some time, I deem it a fit case to grant the concession of regular bail to the petitioner.
Therefore, without expressing any opinion on the merits of the case, the instant petition is allowed. The petitioner is ordered to be released on regular bail on his furnishing requisite bonds to the satisfaction of the trial Court/Duty Magistrate concerned.
