Prayer in this writ petition filed under Articles 226 and 227 of the Constitution of India is for issuance of a writ in the nature of mandamus for directing the respondents to issue the letter of allotment of the Convenience Shop No.2 (with basement) situated in Informal Sector, Narnaul, to the petitioner being the highest bidder in an open e-auction held from 26.05.2015 to 28.05.2015.

The grievance of the petitioner is that on 26.05.2015 e-auction started at 12.00 noon and continued till 3.00 p.m. on 28.05.2015. It is claimed that petitioner offered highest bid amount of ` 33,50,000/- for the aforesaid Shop No.2. However, despite depositing 10% of the bid amount as per the terms and conditions of the e-auction, allotment letter has not Ravinder Singh 2016.11.16 12:14 I attest to the accuracy and authenticity of this document

Learned counsel for respondents No.2 and 3, after seeking instructions from the Managing Director, who is present in Court, states that respondent-Corporation is agreeable for allotment of the said shop at the rate of ` 33.5 lakhs to the petitioner.

In view of the consensus between the parties, writ petition is disposed of as infructuous. Needless to say that petitioner shall be liable to pay ` 33.5 lakhs to the respondent-Corporation on or before 31.12.2016. (AJAY KUMAR MITTAL) JUDGE (RAMENDRA JAIN) November 10, 2016 JUDGE R.S.
