The petitioners have filed the instant petition under Article 226 of the Constitution of India, seeking issuance of a writ of certiorari for quashing the Notification dated 19.01.2024 (Annexure P-4), issued by respondent No.3-Finance Department, so long as it limits the salary to a fixed amount along with increments being contrary to Article 14 of the Constitution of India and the principle of 'equal pay for equal work'. Further, seeking issuance of a writ of mandamus directing the respondents to pay the petitioners minimum of pay scale + dearness allowance + grade pay + other allowance along with arrears in lieu of the judgment of Hon'ble Supreme Court in State of Punjab Vs. Jagjit Singh : (2017) 1 SCC 148 from the day the petitioners have completed their 10 years of service with the respondents. Further to release the arrears after the date of regularization till orders and to change the age of retirement from 58 to 60 years for Group-D posts. 2.
After arguing the case for sometime, learned assisting counsel for the petitioners wishes to withdraw the instant petition with liberty to file a fresh one on the same cause of action with better particulars.
